ATLANTA — In the most important appeal of the Obamacare constitutional saga, today was the best day yet for individual freedom. The government’s lawyer, Neal Katyal, spent most of the hearing on the ropes, with the judicial panel extremely cautious not to extend federal power beyond its present outer limits of regulating economic activity that has a substantial aggregate effect on interstate commerce.As the lawyer representing 26 states against the federal government said, “The whole reason we do this is to protect liberty.” With those words, former solicitor general Paul Clement reached the essence of the Obamacare lawsuits. With apologies to Joe Biden, this is a big deal not because we’re dealing with a huge reorganization of the health care industry, but because our most fundamental first principle is at stake: we limit government power so people can live their lives the way they want.

Follow-up comment rss or Leave a TrackbackQuestions asked by the panel in oral argument frequently shed absolutely no light on how the panelists will ultimately vote. In fact, I have been impressed by how frequently a question, seemingly indicating a panelist is leaning in one direction, is uttered by a panelist who votes the opposite.
Nonetheless, I’m hopeful.
(Either way, of course, SCOTUS will give us our final answer – hopefully, before Obama further pads the Court with far left progressive pukes.)

I think the SCOTUS is more likety to rule against Obamacare than most pundits think, but that’s because I am a very simple-minded person and I think most things come down to power. Obamacare is a massive, unprecedented power-grab by the Executive and Legislative branches of govt. The only check on that is the Judicial branch. It cannot escape the notice of the SCOTUS that if they rule in favor of Obamacare they are giving future Presidents and future Congresses blank checks to implement wholesale checks on freedom in this country without judicial review or remedy.

I had not thought about it from that angle, Cosmic. But, I surely see the logic.
Those 9 Supremes certainly relish the power in their hands. I could see more than the 4 or 5 “regulars” on the right side taking issue with one aspect or another of it just for the reason you stated.
God is a “jealous” God, according to scripture. Some on the Court really view themselves that way…so, jealousy might just be what saves us on this one. Gonna be interesting.
